Bio

Senior Director at Kane Russell Coleman Logan, PC, Mr. Hathaway is a trial lawyer who practices in the Complex Commercial Litigation Section.  He has significant experience in federal and state courts as well as in arbitration. Richard represents a wide range of clients from individuals and small proprietors to large corporate entities and Fortune 500 companies.

Scope of Practice:
Non-compete enforcement and defense, Texas Uniform Trade Secrets Act, construction litigation, real estate litigation (brokerage and landlord/tenant), energy industry litigation, health law litigation, emergency relief, restraining orders and injunctive relief; partnership disputes, Texas Uniform Fraudulent Transfer Act, and general complex commercial litigation.

Recent Representative Success: 

2019:  Obtained Partial Summary Judgment finding liquidated damages clause was an illegal penalty.  Mehta v Hartman Investments, LLC, et al., DC-18-17296, 134th Judicial District Court, Dallas County, Texas;

2019:  Obtained Orders Granting Partial Dismissal on Anti-Slapp basis for both named defendants.  Neuron Shield, LLC., et. al. v. Adrianna Villarreal, et al., DC-18-10648, 298th Judicial District Court, Dallas County, Texas;

2019:  Defended Federal Eastern District of Texas' dismissal of all but a small subset of a Securities Fraud Claim, Masel, et al. v Villarreal, et al.,  No. 18-40499, United States Court of Appeals for the Fifth Circuit;

2018:  Obtained Dismissal of Plaintiffs' First Amended Complaint containing fourteen causes of action including Federal Securities Fraud and RICO, Masel, et al. v Villarreal, et al., No. 4:2017-cv-00533, United States Eastern District of Texas;

2016-17:  Jury Verdict and Final Judgment award for Plaintiffs in complex construction dispute.  Sun SCP Investment Company, LLC, v. W/B General Contractors, LLC, No. DC-13-06147, 101st Judicial District Court, Dallas County Texas;

2015-2016:  Substantial Jury Verdict and Final Judgment award for Defendants' counterclaim in complex business separation/tortious interference dispute between physicians.  Mintz, v. Nesbitt, et. al., No. DC-14-8087, 14th Judicial District Court, Dallas County Texas;

2015:  Second Chair, Jury Verdict in favor of Defendants in connection to services provided to subsidiary connected to Allan Stanford Ponzi Scheme.  Ralph S. Janvey v. Dillon Gage, Inc., et al., 3:15-cv-00992, United States Northern District of Texas.
